Terms of Use for Top Cash Backi

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING OUR WEBSITE, SERVICES, OR APPLICATIONS, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.

1. Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “User”) and Top Cash Backi LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of the cashbacki.top website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Service”).

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. Our Privacy Policy, which details how we collect and use your information, is also incorporated by reference into these Terms.

2. Description of Service

Top Cash Backi provides a service that allows registered users to earn cashback on purchases made at affiliated third-party merchant websites (“Partner Merchants”). We provide links to these Partner Merchants through our Service. When you make a qualifying purchase from a Partner Merchant after clicking a link from our Service, we receive a commission, a portion of which we share with you as “Cashback.” The Service is free to use for all registered members.

3. User Eligibility and Account Registration

Eligibility: To use the Service and create an account, you must be at least eighteen (18) years of age and a resident of the United States. By creating an account, you represent and warrant that you meet these eligibility requirements.

Account Creation: You must register for an account to access the core features of the Service. You agree to: (a) Provide accurate, current, and complete information as may be prompted by any registration forms on the Service (“Registration Data”); (b) Maintain the security of your password and identification; (c) Maintain and promptly update the Registration Data, and any other information you provide to us, to keep it accurate, current, and complete; (d) Accept all risks of unauthorized access to the Registration Data and any other information you provide to us.

You are responsible for all activities that occur under your account. You may only hold one account with Top Cash Backi. The creation of multiple accounts by a single user is strictly prohibited and will result in the termination of all associated accounts and forfeiture of all accrued Cashback.

4. Cashback and Rewards Program Rules

Earning Cashback: Cashback is earned only on qualifying purchases made through tracked links on the Top Cash Backi Service. To qualify, you must:

  1. Be logged into your Top Cash Backi account.
  2. Click on a link from our Service to a Partner Merchant.
  3. Complete your purchase in the same session that was initiated after clicking our link.
  4. Ensure that your browser’s cookies are enabled and that you do not have any ad-blocking software that may interfere with tracking.

Exclusions: Not all items or product categories may be eligible for Cashback. Partner Merchants have their own rules and exclusions, which are subject to change without notice. We will make a reasonable effort to display these exclusions, but we are not responsible for any changes or inaccuracies. Cashback is not earned on taxes, shipping fees, or any portion of a purchase paid for with gift cards or store credit.

Tracking and Validation: After a qualifying purchase, the transaction will typically appear in your account as “Pending.” The status will change to “Confirmed” or “Approved” once the Partner Merchant confirms the purchase and pays the commission to us. This process can take anywhere from 30 to 120 days, or longer, depending on the Partner Merchant’s return policy and reporting cycle. If you return, cancel, or exchange an item, the corresponding Cashback will be voided. We reserve the right to adjust your account balance for any clerical errors or returns.

Payouts: Once your Confirmed Cashback balance reaches the minimum payout threshold (as specified on our Payouts page), you may request payment via the available methods (e.g., PayPal, Bank Transfer). You are solely responsible for any taxes that may be due on your earned Cashback.

5. Advertising Platform Policies: Google Ads, Bing Ads, Yahoo Ads, and Others

This section outlines the strict rules regarding the promotion of our Service or our Partner Merchants using paid advertising channels, including but not limited to Google Ads, Microsoft (Bing) Ads, Yahoo Ads, Facebook Ads, and other search engine marketing (SEM) or pay-per-click (PPC) platforms. Violation of these policies is a material breach of these Terms and will result in the immediate and permanent termination of your account and forfeiture of all accrued Cashback.

a. Prohibition of Brand Keyword Bidding: You are strictly forbidden from bidding on any keywords that include our brand name or trademarks, or any misspellings or variations thereof. This includes, but is not limited to, keywords such as “Top Cash Backi,” “TopCashBacki,” “Top Cash Backi coupons,” “Top Cash Backi reviews,” etc. You are also prohibited from bidding on the brand names or trademarks of our Partner Merchants in conjunction with our brand name (e.g., “Nike Top Cash Backi”).

b. Prohibition of Direct Linking: You may not link directly to Top Cash Backi or to a Partner Merchant’s website from any paid search ad. All paid traffic must first be directed to a landing page or website that you own and operate. This landing page must not impersonate our brand or the brand of our Partner Merchants.

c. Use of Trademarks in Ad Copy: You may not use our trademarks, logos, or brand name (“Top Cash Backi”) in the title, ad copy, or display URL of any paid advertisement. You may not create ads that imply an official endorsement or partnership with Top Cash Backi beyond your status as a general user.

d. Misleading and Deceptive Advertising: Your advertisements must not be misleading. You cannot make false claims about the amount of Cashback offered or use phrases like “Official Site” in your ads. All ad copy must be truthful and accurately represent the offer. You are prohibited from creating advertisements or landing pages that impersonate the look and feel of the Top Cash Backi website or our Partner Merchants’ websites (a practice known as “brandjacking” or “cybersquatting”).

e. Compliance with Platform Policies: Your advertising activities must fully comply with the terms of service of the respective advertising platform (e.g., Google Ads Policies, Microsoft Advertising Policies). Any violation of these third-party platform policies will be considered a violation of our Terms of Use.

f. Consequences of Violation: We actively monitor advertising platforms for violations of these terms. If we determine, in our sole discretion, that you have violated any of the rules in this section, we will take immediate action, which includes, without limitation:

  • Immediate and permanent termination of your Top Cash Backi account.
  • Forfeiture of any and all Cashback in your account, whether Pending or Confirmed.
  • Legal action to recover damages caused by your prohibited advertising activities.

6. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Top Cash Backi LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Third-Party Links and Merchants

The Service contains links to Partner Merchants and other third-party websites. These links are provided for your convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. All transactions you make with Partner Merchants are between you and the merchant. Top Cash Backi is not an agent of any Partner Merchant and is not a party to your transaction.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. If you wish to terminate your account, you may do so by contacting our support team. Upon termination, your right to use the Service will cease, and any unpaid Cashback may be forfeited, particularly in cases of termination due to a breach of these Terms.

9. Disclaimer of Warranties; Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL TOP CASH BACKI LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICE IS LIMITED TO THE TOTAL AMOUNT OF CONFIRMED CASHBACK IN YOUR ACCOUNT AT THE TIME THE CLAIM ARISES.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms shall be determined by binding arbitration in Los Angeles, California. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. YOU AND TOP CASH BACKI LLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

11. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Top Cash Backi LLC regarding our Service and supersede all prior agreements. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck, and the remaining provisions will be enforced. Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site and updating the “Effective Date” at the top. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
